It looks to me like any footnote flow that I've seen. (Con)TeXt does the best it can. If there were room for footnote(9) to be on page 2, then there wouldn't be enough room for the line of text ("Orphée... les") that refers to it. The convention that I have seen is to put the footnotes on the following page.
