since pdftex is free this is ok, but
(1) they should clearly mention it somewhere in their documentation (2) there should be a clear indication of a version/release number
these are not obligations on MacKichan, all they can be is a request.
The _obligation_ on MacKichan is that they
a) do not claim copyright or obscure the existing copyrights
b) make the source available
c) release the source of any improvements
I am willing to bet much money that they have not followed b)
