ConTeXt in TL 2012 provides both Mark II and IV. There is no plan to kick MkII out of TeX Live.

Of course you can use it. It is indeed true that ConTeXt uses MkII for XeTeX and that MkII it is frozen, but nothing prevents you from using XeTeX with ConTeXt. Any of the following commands should work: texexec --xtx filename[.tex] texexec --xetex filename[.tex] context --xetex filename[.tex]
