In context-excursion it says ...
"After the definition texts can be marked by: \marking[.1.]{.2.} .1. name .2. text and recalled by: \getmarking[.1.][.2.]"
But in MkIv sections there is already text marked ...

At least it looks as if there were some text marked by mark={mark}!
